By purchasing one of the DrumAccess libraries, I approve the End User License Agreement available below.
This End User License Agreement (hereinafter referred to as "EULA") is a legal agreement between you (hereinafter referred to as "the User") and Lee JULIEN (hereinafter referred to as "the Owner") for the use of a DrumAccess library (hereinafter referred to as “the Software”). By installing, copying or using the Software, User agrees to be bound by the terms and conditions of this EULA.
1. User License
Subject to compliance with the terms of this EULA, Owner Lee JULIEN grants the User a non-exclusive license.
2. Restrictions
- a. The User may not copy, modify, distribute, sell or rent the Software, in whole or in part.
- b. The User cannot circumvent the security measures integrated into the Software.
3. Property
The Software and all intellectual property rights relating thereto remain the exclusive property of Lee JULIEN. This EULA does not confer any ownership rights in the Software except as expressly granted herein.
4. Duration and Termination
This EULA is effective upon installation of the Software and remains in effect until terminated. Lee JULIEN reserves the right to terminate this EULA at any time in the event of violation of the terms of this contract by the User. In the event of termination, the User must cease all use of the Software and destroy all copies in his possession.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Lee JULIEN will not be liable for any direct, indirect, special, consequential or punitive damages arising out of the use of or inability to use the Software.
6. General provisions
- a. This EULA constitutes the entire agreement between the parties regarding the use of the Software and supersedes all prior or contemporaneous agreements.
- b. This EULA is governed and construed in accordance with the laws in force in Canada. Any dispute arising from this EULA will be subject to the exclusive jurisdiction of the courts of the province of Quebec.
- c. If any provision of this EULA is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
- d. Lee JULIEN's failure to exercise any right or remedy provided for in this EULA does not constitute a waiver of that right or remedy.

By installing, copying or using the Software, the User acknowledges having read, understood and accepted the terms and conditions of this EULA.
8. Refund
- a. Lee JULIEN will not provide any refund to the User, regardless of the reason, unless expressly provided otherwise in this EULA.
- b. No refund will be provided for the purchase of the Software, whether in the event of an incompatibility, non-compliance with the User's expectations or for any other reason.
- c. No refund will be provided for the purchase of the Software, whether in the event of a major defect, incompatibility, non-compliance with the User's expectations or for any other reason.licences for the DrumAccess Software are final.
